By accessing or using the Diamond Harbor Platform (“Platform”), you agree to be bound by these Terms & Conditions (“Terms”), our Privacy Policy, and all applicable laws and regulations. If you do not agree to these Terms, you are prohibited from using or accessing the Platform.

These Terms constitute a legally binding agreement between you and Diamond Harbor (“Company,” “we,” “us,” or “our”). We reserve the right to modify these Terms at any time. Continued use of the Platform following the posting of changes constitutes acceptance of those changes.

To register for and use the Platform, you must meet all of the following eligibility requirements:

• You must be at least 21 years of age or older.
• You must be a legal resident of the United States or another jurisdiction where access to free social casino platforms is lawful.
• You must not be prohibited by law from participating in free social casino games in your jurisdiction.
• You must not be an employee, contractor, officer, or director of Diamond Harbor, or an immediate family member or household member of any such person.
• You must not have previously been banned or suspended from the Platform.

By registering, you represent and warrant that you meet all eligibility requirements. We reserve the right to verify your eligibility at any time and to suspend or terminate accounts that do not meet these requirements.

To access certain features of the Platform, you must register for an account. When registering, you agree to provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You agree to notify us immediately at support@diamondharbor.com of any unauthorized use of your account or any other security breach. We will not be liable for any loss or damage arising from your failure to protect your account credentials.

Each person may maintain only one account. Creating multiple accounts is prohibited and may result in termination of all associated accounts and forfeiture of all virtual currency balances.

Diamond Harbor uses a virtual currency called Gold Coins (“GC”) exclusively for gameplay purposes. You expressly acknowledge and agree that:

• Gold Coins are a virtual currency with no real-world monetary value.
• Gold Coins cannot be exchanged, transferred, redeemed, or converted for real money, prizes, goods, or services of any kind.
• Gold Coins are granted by the Company at our sole discretion and may be modified, reduced, or removed at any time.
• New registered users receive 50,000 GC upon registration and an additional 100,000 GC upon first login, both at no charge and with no purchase required.
• Gold Coins do not constitute property and you have no ownership interest in any virtual currency.
• We reserve the right to modify the amount, availability, or distribution of Gold Coins at any time without prior notice.

You agree not to engage in any of the following prohibited activities:

• Using automated tools, bots, scripts, or other methods to access or interact with the Platform.
• Attempting to exploit, hack, reverse-engineer, or circumvent any security or access controls on the Platform.
• Using the Platform for any unlawful purpose or in violation of any applicable federal, state, or local law.
• Impersonating another person or entity or misrepresenting your affiliation with any person or entity.
• Engaging in any conduct that restricts or inhibits any other user’s use or enjoyment of the Platform.
• Transmitting any unsolicited advertising, spam, or other promotional materials.
• Attempting to interfere with the proper working of the Platform or its servers.
• Sharing account credentials or allowing others to access your account.

All content on the Platform, including but not limited to text, graphics, logos, images, game assets, software, and code, is the property of Diamond Harbor or its content suppliers and is protected by applicable intellectual property laws. The Platform and all content are provided for your personal, non-commercial use only.

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on the Platform without prior written consent from the Company.

The Platform may contain links to third-party websites, services, or resources that are not owned or controlled by Diamond Harbor. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party sites or services. We strongly advise you to review the privacy policy and terms of service of any third-party sites you visit.

Game content on the Platform is provided by third-party game developers and studios. Game outcomes are determined by certified random number generators. Diamond Harbor makes no representations or warranties about the accuracy or completeness of game information provided by third parties.

THE PLATFORM IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL DIAMOND HARBOR, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OR INABILITY TO USE THE PLATFORM.

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any dispute arising under or relating to these Terms or your use of the Platform shall be resolved by binding arbitration administered by the American Arbitration Association (“AAA”) under its Commercial Arbitration Rules.

YOU AGREE THAT ANY CLAIMS MUST BE BROUGHT IN YOUR INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE ACTION.

We may terminate or suspend your account and access to the Platform immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the Platform will cease immediately, and any Gold Coins or account data associated with your account may be permanently deleted.
